Orbit Delivery — Rider Terms

These terms are a contract between you (the Rider) and Orbit Delivery Ltd trading as Orbit Delivery (Orbit, we, us), company number 17464514, of 2nd Floor, College House, 17 King Edwards Road, Ruislip, London, HA4 7AE. They apply to your use of the Orbit Driver App and to every delivery you carry out through it. By ticking "I accept" when you sign up, you agree to them. Please read them carefully — section 2 in particular explains the nature of the relationship, and section 6 explains rules whose breach is a criminal offence.


1. What Orbit is

Orbit runs a technology platform that connects takeaway shops needing a delivery made with riders who are available to make it. Through the app you can see delivery jobs offered by shops near you, choose whether to accept them, and be paid for the ones you complete. Orbit is not a food business, does not employ riders, and does not guarantee you any minimum number of jobs or level of earnings.

2. You are self-employed

2.1 You provide delivery services as an independent, self-employed contractor. Nothing in these terms creates an employment relationship, a worker relationship, a partnership or an agency between you and Orbit, or between you and any shop.

2.2 In particular:

2.3 You are responsible for your own tax and National Insurance. Orbit does not deduct tax from your pay. You must register with HMRC as self-employed if required, and keep your own records. Orbit will give you a statement of your earnings in the app.

2.4 You are not entitled to holiday pay, sick pay, pension contributions, or any other employment benefit from Orbit.

3. Right of substitution

3.1 You may appoint another person (a Substitute) to carry out deliveries on your behalf, at any time and for any reason, without asking Orbit's permission for the individual job. You do not have to explain why.

3.2 The only conditions are that your Substitute must:

These conditions exist because the law requires us to know that every person delivering through the platform has the right to work in the UK. They are not a restriction on your choice of who to send.

3.3 You are responsible for paying your Substitute. Orbit pays the account that carried out the delivery, or you, as you and your Substitute agree between you and record in the app.

3.4 You remain responsible for the quality of any delivery carried out by your Substitute.

4. Signing up and your account

4.1 To use the platform you must be 18 or over, have the right to work in the UK, and hold whatever licence and insurance the law requires for your vehicle (section 5).

4.2 Your account is personal to you. You must keep your login details secret and use the app on one device at a time. Signing in on a new device signs out the old one and we will email you so you can tell us if it wasn't you.

4.3 You must keep your details (phone number, vehicle, documents) up to date in the app.

5. Verification, documents and the selfie check

5.1 Before you can go online you must upload, and keep in date:

Bicycle and legal e-bike riders do not need a licence or motor insurance.

5.2 Each time you sign on to a shift you must take a live selfie, which is compared to your reference photo using facial recognition. This is biometric data and you give your explicit consent to the check as a condition of using the platform; the Privacy Policy explains how the images are handled, how long they are kept and how to withdraw consent. If the check fails you can retry; repeated failures are reviewed by a person before any action is taken. If our comparison service is unavailable, the attempt is not counted as a failure and you will be asked to try again shortly. Your reference photo must show only your own face, clearly; a photo that does not will be rejected and you will be asked to retake it.

5.3 We will ask licensed riders for a fresh DVLA check code once a year. If you lose your licence card, you can keep working while a replacement is on its way if you give us your licence number, a DVLA check code and proof that you have ordered the replacement.

5.4 We will remind you before documents expire. If a document expires, you will not be offered jobs until a valid replacement is uploaded and approved.

5.5 We may ask you to re-verify at any time, and we may suspend your account while a check is outstanding.

6. Your account is yours alone — illegal working

6.1 You must never let anyone else use your account, and you must never deliver using someone else's account. The only lawful way for another person to deliver on your behalf is as a verified Substitute under section 3.

6.2 Allowing an account to be used by someone without the right to work in the UK is a criminal offence. From 1 October 2026, delivery platforms must check the right to work of everyone who delivers through them, including substitutes, and face civil penalties of up to £45,000 per illegal worker (£60,000 for a repeat breach). Knowingly working illegally, or knowingly letting someone do so, can also be a criminal offence.

6.3 If we find that your account has been used by anyone other than you or a verified Substitute, we will permanently close your account, withhold or recover any earnings from the affected deliveries, and report the matter to the authorities where required. The selfie check may be repeated at any point during a shift.

6.4 If you are asked by anyone — including a shop — to hand over your phone or let someone else deliver on your account, refuse, hand the job back in the app, and tell us.

7. Carrying out deliveries

7.1 When you accept a job you agree to collect the order from the shop and deliver it to the customer with reasonable care and within a reasonable time, keeping food upright, at a safe temperature and uncontaminated. You must use an insulated bag.

7.2 You must follow the app's steps: confirm arrival at the shop, enter the shop's pickup code, and confirm delivery (with a photo where the customer asks for the order to be left). These steps are how you get paid, and how the shop and customer see where their order is.

7.3 You must deliver only to the customer or as they instruct, never leave food with a third party unless asked, and never consume or tamper with an order.

7.4 You must comply with all road traffic law, not use a handheld phone while driving or riding, and not carry passengers or other people's goods on an Orbit delivery.

7.5 You must treat shop staff and customers politely. Abuse, threats, discrimination or harassment will result in your account being closed.

7.6 Cash orders. You will only be offered cash orders by a shop that has marked you as trusted for cash. On a cash order you collect the amount shown in the app from the customer and hand all of the cash to that shop at the end of your run, confirming the handover in the app. The cash belongs to the shop: you must never keep any of it, including as pay — your pay and tips for cash orders are paid by Orbit in the usual way. A missing or late cash handover may lead to suspension under section 13 and recovery of the missing amount.

8. Handing a job back

8.1 Before collecting the food, you may hand a job back in the app at any time without giving a reason. The job is re-offered to other riders.

8.2 After collecting the food, you may still hand a job back if you cannot complete it (for example a breakdown, an accident, or a wrong order in the bag). You must give the reason in the app, return the food to the shop, and confirm the return in the app when you are back at the shop. Until you confirm, your location continues to be shared so the shop knows where its order is. You are not paid for a handed-back job.

8.3 Repeated hand-backs after collection, or failing to return food, are treated as a breach of these terms.

9. Pay

9.1 You are paid per completed delivery. The amount for each job is shown before you accept it and is the guaranteed minimum for that job. It is made up of a base fee, a distance element for miles beyond the included distance, waiting pay for time spent waiting at the shop beyond the included period, and 100% of any tip the customer adds. The current rates are published in the app under Pay Policy and may be changed on 14 days' notice in the app; a change never applies to a job you have already accepted.

9.2 Waiting pay is calculated from the time you confirm arrival at the shop to the time you confirm collection, so confirm both promptly.

9.3 Your earnings accumulate in your Orbit balance. You may:

9.4 Payouts are made through Stripe to the bank account you connect. You must complete Stripe's identity checks to receive money. Orbit does not hold your bank details.

9.5 If a job is cancelled after you have collected the food through no fault of yours, we will pay you the base fee for that job. If a payment to you is made in error, we may correct it against future earnings and will tell you when we do.

9.6 You are responsible for your own tax on all amounts paid to you.

10. What Orbit charges

Orbit charges shops, not riders. Orbit's platform fee is charged to the shop for each delivery and is never deducted from the pay shown to you. The only amount you pay Orbit is the optional instant cash-out fee in section 9.3.

11. Insurance and liability

11.1 You are responsible for insuring yourself, your vehicle and any third-party liability arising from your deliveries. For motorised vehicles this means hire and reward cover; ordinary social/commuting insurance is not valid for food delivery and you will be committing an offence if you deliver without it.

11.2 Orbit does not insure you, your vehicle or your equipment, and is not liable for loss, damage or injury arising from your deliveries except where caused by our negligence or where the law does not allow us to exclude liability.

11.3 You are responsible for any loss you cause to a shop, customer or third party through your negligence or breach of these terms.

12. Your data and location

12.1 While you are online the app tracks your location continuously, including in the background and while you use a navigation app, so that jobs can be offered to you and shops and customers can see where their order is. Tracking stops when you go offline. Full details are in our Privacy Policy at orbitdelivery.co.uk/privacy, which forms part of these terms.

12.2 Your first name, vehicle type and live location are shared with the shop and customer for each delivery you carry out.

13. Suspension and ending this agreement

13.1 You may stop using Orbit at any time by going offline, and may delete your account from the Profile screen. Any balance is paid out at the next weekly payout.

13.2 We may suspend your account immediately while we investigate a suspected breach of sections 5, 6 or 7, an unresolved hand-back, or a complaint. We will tell you why, and you can respond through the in-app Inbox. You can ask for any suspension or closure to be reviewed by a person by contacting us within 14 days; we aim to reply within 7 days.

13.3 We may close your account on 7 days' notice for any reason, or immediately for a serious breach — including account sharing, illegal working, dishonesty about documents, tampering with food, abuse, or serious or repeated breaches of section 7.

13.4 Any earned but unpaid balance is paid to you on closure, less any amounts we are entitled to withhold under section 6.3 or recover under section 9.5.

14. Complaints and disputes

14.1 If you have a problem, contact us through the in-app Inbox or at support@orbitdelivery.co.uk. We aim to respond within 3 working days.

14.2 If you disagree with a pay calculation, tell us within 30 days of the payout and we will review it against the job record.

14.3 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.

15. General

15.1 We may update these terms. We will give you at least 14 days' notice in the app of any material change; continuing to use the platform after that date means you accept the new terms. You can always see the current version at orbitdelivery.co.uk/rider-terms.

15.2 If any part of these terms is found to be unenforceable, the rest continues to apply.

15.3 These terms, together with the Privacy Policy and the Pay Policy in the app, are the whole agreement between you and Orbit.
